I got a question in mail yesterday mocking over why iPOTT have ‘TM’ all over? What big deal? What did you get putting TM for every name? Guess what, I love such questions, honestly. It gives me a topic new.. Before I talk about TM lets talk about names. While selecting a name for the product or company it is worth putting in some thought , because it shows and its worth it.. the name can either be unique or descriptive. Unique like Google or iPOTT or descriptive like download.com or jobstreet.com. Whatever be the case give some thoughts before naming….one software company was taking my advice on the name they have selected for their software. Oak accounting software.. (no offence! I am writing this with their permission) but what has oak got to do with accounts or software. It’s a strongly built software.. so? What about puzzle payroll? What does it convey? If you say cheetamail , it can be descriptive : reaches fast. Lets move on to ‘TM’ , so you take trouble, decide a name, make it popular what next. Of course safe guard it! There will be lot of websites that will want to take advantage of your popularity. Let me take an example of unique names. The google, how many out their try using the google brand (google has more than 150 names for google TMed) to grab attention. Take a look at this site call Googlle Institute, an Indian Company making use of the name google with a wrong spelling. They have even used google logo colors, don’t miss the favicon..what google is going to do about this site..I will keep you updated through this blog. (updating this on 16 Jan 10: Guess what the trying to bag on Google had made declarations that it has no connection to google what-so-ever, not affiliated to google etc., but today I cant find the site..this is the power of trade marking..) I will now take the example of iPOTT. We have used the word ‘ipott’ for the first time. But today if we do a google search for iPOTT, there will be minimum 4 other companies using the word iPOTT for various purposes. There are 3 websites with the name iPOTT which has come up from across the globe. There are a number of users calling themselves iPOTT, all of a sudden. At least 6 Chinese companies attempted to register the companies with the name iPOTT. Since we hold the TM of iPOTT, we were able to stop 3 companies from using the name. The others are being “handled”. Hence the most important reason for TM is to protect your IP. Other than this I can add the following:

Oak looked so great when we thought of it. As a general practice we thought of it from our point of view. It did not occur what it is conveying. You rightly said no one is going to analyse and tell me, my software name is ‘not relevant’, but now i am sure a right name will being more attention.
